Welcome to Mews & Co. The terms "we", "us" and "our" refer to Mews & Co. Mews & Co. operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Mews & Co. is powered by Shopify, which enables us to provide the Services to you. Our business name, address and contact details are listed in our Contact Information.

These terms and conditions, together with the policies referenced in them (these "Terms"), describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

YOUR CONSUMER RIGHTS COME FIRST. Nothing in these Terms excludes, limits or waives any right or remedy you have under the consumer protection laws of the place where you live that cannot be excluded by contract, including legal warranties. If any part of these Terms conflicts with those laws, those laws apply and the rest of these Terms remains in effect. Any clause that is not permitted under your local law (for example, under the Quebec Consumer Protection Act) does not apply to you.

SECTION 1. ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority in your state, province or country of residence, or that you are using the Services with the involvement of a parent or guardian. You agree to provide accurate, current and complete information, including your shipping address and email, and to keep your account credentials secure. You may not transfer your account to anyone else.

SECTION 2. OUR PRODUCTS
We make every effort to describe and show our products accurately. Colors and appearance may vary slightly depending on your screen and device settings. Product dimensions and materials are stated in each listing. We may change product descriptions or discontinue products at any time, and we may limit quantities sold to any person or region.

SECTION 3. SAFE USE WITH YOUR PETS
Every pet is different. Please read each product description, choose products suited to your pet's size, age and habits, and supervise your pet when introducing a new product, especially toys, feeders and accessories with small parts. Inspect products regularly and stop using any product that is worn, cracked or damaged, or that your pet is chewing apart or swallowing. Our products and content are not veterinary advice. If you have any concern about your pet's health, eating habits or behaviour, please consult a veterinarian.

SECTION 4. ORDERS
When you place an order, you are making an offer to buy. We will confirm your order by email. We may decline or cancel an order, for example if a product is unavailable, if we cannot ship to your address, or if we suspect fraud. If we cancel an order after you have paid, we will notify you and refund you in full. Cancellations by you, refunds and returns are governed by our Refund Policy. You confirm that your purchases are for your own personal or household use and not for resale.

SECTION 5. PRICES AND PAYMENT
Prices are shown in the currency displayed at checkout. The total price, including shipping charges and any taxes we collect, is shown at checkout before you pay. Import duties or taxes charged by your country on delivery are explained in our Shipping Policy. Prices and promotions may change without notice, but a change never affects an order you have already placed. You confirm that you are authorized to use the payment method you provide.

SECTION 6. SHIPPING AND DELIVERY
Delivery times are estimates and are described in our Shipping Policy. If delivery is late, the remedies in our Shipping Policy and Refund Policy, and any rights you have under your local law, apply.

SECTION 7. INTELLECTUAL PROPERTY
The Services, including the Mews & Co. name, logos, text, photos, graphics, videos and the selection and arrangement of content, belong to Mews & Co. or its licensors and are protected by intellectual property laws. You may use the Services for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify or republish any content from the Services without our prior written permission. Shopify's name and logos are trademarks of Shopify, and other names and logos on the Services belong to their respective owners.

SECTION 8. THIRD-PARTY TOOLS AND LINKS
The Services may include tools, content or links provided by third parties. We do not control them and are not responsible for their content, accuracy or practices. Your use of third-party tools and websites is subject to their own terms and policies.

SECTION 9. RELATIONSHIP WITH SHOPIFY
Mews & Co. is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Mews & Co. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Mews & Co., including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Mews & Co.

SECTION 10. PRIVACY
Personal information we collect through the Services is handled as described in our Privacy Policy. Because the Services are hosted by Shopify, Shopify also processes personal information as described in the Shopify Consumer Privacy Policy.

SECTION 11. REVIEWS AND FEEDBACK
If you send us reviews, photos, ideas or other feedback, you give us a free, worldwide, non-exclusive licence to use, reproduce and publish it in connection with the Services and our marketing. You confirm that you own the content you send, that it is accurate, and that it does not violate anyone's rights or any law. We may moderate or remove content at our discretion, but we will not edit a review in a way that changes its meaning.

SECTION 12. ERRORS
If there is an error in a product description, price or availability, we will correct it. Where your local law allows, if an order was placed at a price that was clearly a mistake, we will contact you and you may choose to pay the correct price or cancel for a full refund.

SECTION 13. PROHIBITED USES
You may use the Services only for lawful purposes. You may not use the Services to break any law, infringe anyone's rights, harass anyone, send spam, upload malicious code, scrape or collect data from the Services, interfere with their security or operation, or impersonate anyone. TO THE EXTENT PERMITTED BY THE LAW THAT APPLIES TO YOU, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", AND WE DO NOT GUARANTEE THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE OR ERROR FREE. THE PRODUCTS WE SELL COME WITH THE COMMITMENTS DESCRIBED IN OUR REFUND POLICY AND WITH ALL LEGAL WARRANTIES THAT YOUR LOCAL LAW PROVIDES AND THAT CANNOT BE EXCLUDED. WHERE YOUR LAW ALLOWS IT, WE EXCLUDE ANY OTHER IMPLIED WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.

SECTION 16. LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY THE LAW THAT APPLIES TO YOU, MEWS & CO. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICES, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER. THIS SECTION DOES NOT LIMIT OUR LIABILITY FOR DEATH OR BODILY INJURY CAUSED BY OUR FAULT, FOR FRAUD, FOR INTENTIONAL OR GROSS FAULT, OR FOR ANY LIABILITY THAT CANNOT BE LIMITED UNDER YOUR LOCAL LAW. IF YOU ARE A CONSUMER IN QUEBEC, THIS SECTION DOES NOT APPLY TO YOU TO THE EXTENT IT IS PROHIBITED BY THE CONSUMER PROTECTION ACT.

SECTION 17. INDEMNIFICATION
To the extent permitted by your local law, you agree to compensate Mews & Co. and Shopify for reasonable losses and costs, including reasonable legal fees, caused by your breach of these Terms or your violation of any law or third party right. This section does not apply to consumers where it is prohibited by law.

SECTION 18. TERMINATION
We may suspend or end your access to the Services if you seriously or repeatedly breach these Terms. Sections that by their nature should continue after termination (including Intellectual Property, Reviews and Feedback, Disclaimer of Warranties, Limitation of Liability and Governing Law) will continue to apply.

SECTION 19. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. However, if you are a consumer, you also benefit from the mandatory protections of the law of the country, province or state where you live, and you may bring a claim before the courts of your place of residence where your local law allows it. Nothing in these Terms requires a consumer to go to arbitration or to waive the right to take part in a class action where that is prohibited by law. We encourage you to contact us first so we can try to resolve any concern quickly and informally.

SECTION 20. SEVERABILITY, WAIVER AND ENTIRE AGREEMENT
If any part of these Terms is found to be invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms and the policies they refer to are the entire agreement between you and us about the Services. You may not assign your rights under these Terms without our consent. We may assign ours, provided this does not reduce your rights as a consumer.

SECTION 21. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version posted on this page at the time you place an order applies to that order. Changes will not apply to orders already placed.
